These terms constitute a legally binding agreement between you and Neil Boyce regarding your access to and use of this website and the services offered through it.   • "Services" refers to the culinary experiences, workshops, and coffee education content described on the website, including Home Brewing Masterclass, Coffee & Cuisine Pairing, and Online Coffee Academy.

  • "We," "Us," "Our," or "Provider" refers to Neil Boyce, the owner and operator of the website and services.

5. Service Descriptions and Pricing

The website describes various culinary experiences and workshops with associated pricing. While I make every effort to ensure that all descriptions, pricing, and other information displayed on the website are accurate and up to date, errors may occasionally occur. In the event that a service is listed at an incorrect price or with incorrect information, I reserve the right to refuse or cancel any orders placed for that service, even if the order has been confirmed and payment has been received.

All prices displayed on the website are in Euros (EUR) and include applicable taxes unless otherwise stated. Prices are subject to change without notice, but any changes will not affect orders that have already been confirmed.

The content provided on the website, including blog posts, articles, and general culinary advice, is for informational and educational purposes only. It does not constitute professional advice in any field. You should always exercise your own judgment and conduct independent research before making decisions based on the information provided.

6. Booking and Cancellation Policy

When you book a workshop or tasting experience through the contact form, the following policies apply:

  • Confirmation: All bookings are subject to confirmation. Submission of the contact form does not guarantee availability. I will respond within 24 hours to confirm your session or suggest alternative dates.
  • Cancellation by Client: If you need to cancel or reschedule a confirmed session, please provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee of 50% of the session price.
  • No-Show Policy: If you fail to attend a confirmed session without prior notice, the full session fee will be charged.
  • Cancellation by Provider: In rare circumstances, I may need to cancel or reschedule a session due to illness, emergency, or unforeseen circumstances. In such cases, you will be offered a full refund or the opportunity to reschedule at no additional cost.
  • Refund Policy: For single sessions, refunds are available if cancellation is requested at least 48 hours before the scheduled session. For monthly online courses, refunds are calculated on a pro-rata basis for unused full weeks, provided cancellation is requested within the first 14 days of the billing cycle.

7. Limitation of Liability

To the maximum extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the website or services.
  • Any conduct or content of any third party on the website.
  • Any content obtained from the website.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Any adverse reaction, allergy, or dietary issue resulting from consumption of food or beverages provided during workshops or tasting experiences.

The website and all content, services, and products available through it are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. I expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these terms shall exclude or limit my liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

8. User-Generated Content

At this time, the website does not allow users to post, upload, or submit content directly. However, if in the future I introduce features that permit user-generated content (such as comments, reviews, or testimonials), the following rules will apply:

  • You retain ownership of any content you submit, but you grant me a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.
  • You warrant that any content you submit does not violate the rights of any third party, including copyright, trademark, privacy, or publicity rights.
  • You agree not to submit content that is defamatory, obscene, abusive, threatening, harassing, hateful, discriminatory, or otherwise objectionable.
  • I reserve the right to remove any user-generated content at my sole discretion without notice.

I strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit. Specifically, the website uses Google Fonts, Font Awesome, and Google Maps, which are governed by their respective terms of service and privacy policies.

10. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the invalidity or unenforceability of that provision shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.

You agree to defend, indemnify, and hold harmless Neil Boyce and his affiliates, contractors, agents, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the website.
  • Your violation of any term of these Terms of Use.
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
  • Any claim that your use of the website caused damage to a third party.

This defence and indemnification obligation will survive these Terms of Use and your use of the website.

I may terminate or suspend your access to the website immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Use. Upon termination, your right to use the website will immediately cease. All provisions of these terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms of Use, together with the Privacy Policy and any other legal notices published by me on the website, shall constitute the entire agreement between you and me concerning the website and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written, relating to the subject matter hereof.
